PETS AND GO TERMS OF SALE, LIVE ANIMAL SHIPPING, REFUND, AND LIABILITY POLICY By purchasing, reserving, financing, accepting delivery of, or otherwise acquiring any animal from Pets and Go (“Company,” “Seller,” “we,” “our,” or “us”), the purchaser (“Customer,” “Buyer,” or “you”) acknowledges that they have read, understood, and agreed to be legally bound by the following Terms and Conditions. ⸻ 1. ALL SALES ARE FINAL All sales of live animals are final. Due to the unique nature of live animals and the expenses associated with their care, housing, feeding, reservation, and transportation, Pets and Go does not provide refunds, exchanges, credits, or cancellations except where expressly required by applicable law. Refunds shall not be granted for: * Buyer’s remorse; * Change of mind; * Financial hardship; * Family or personal circumstances; * Relocation; * Failure to obtain permits or licenses; * Landlord, homeowner association, or municipal restrictions; * Inability to care for the animal; * Discovery of local ownership restrictions after purchase; * Any reason not specifically covered by an approved claim under this policy. ⸻ 2. PAYMENT PLAN POLICY All deposits, reservation fees, installment payments, and payment plan payments are strictly non-refundable. By entering into a payment plan, the Customer agrees that all payments made are consideration for reserving the animal and compensating Pets and Go for housing, feeding, maintaining, and withholding the animal from sale to other prospective buyers. Failure to complete a payment plan shall constitute abandonment of the transaction and result in forfeiture of all funds previously paid. Pets and Go reserves the right to cancel the payment plan, retain all monies paid, and relist or sell the animal without further notice. ⸻ 3. LIVE ARRIVAL GUARANTEE Pets and Go guarantees that all animals shipped are alive and in acceptable condition at the time they are transferred to the shipping carrier. The Customer is responsible for being available to receive the shipment on the first delivery attempt and must inspect the animal immediately upon delivery. Failure to receive the shipment promptly may void any guarantee offered by Pets and Go. ⸻ 4. DEAD ON ARRIVAL (DOA) POLICY In the rare event that an animal arrives deceased (“Dead on Arrival” or “DOA”), the Customer must notify Pets and Go immediately upon delivery. To be eligible for review of a DOA claim, the Customer must provide all of the following: 1. A continuous, unedited video recording beginning before the shipping container is opened. 2. Clear footage of: * The unopened package; * The shipping label and tracking information; * The condition of the shipping container; * The original packing materials; * The animal being removed from the packaging; * Evidence demonstrating that the animal was deceased upon arrival. 3. Documentation sufficient to verify that the animal received is the same animal shipped by Pets and Go. Failure to provide the required video evidence shall result in immediate denial of any claim. Pets and Go reserves the sole and exclusive right to determine the validity of any DOA claim. ⸻ 5. SHIPPING DELAYS AND CARRIER LIABILITY Pets and Go shall not be responsible for delays, mishandling, routing errors, missed deliveries, weather events, mechanical failures, labor disputes, natural disasters, acts of God, or any other occurrence caused by FedEx or any third-party shipping carrier. Once an animal has been tendered to the carrier, Pets and Go relinquishes control over the shipment and shall not be liable for any loss, injury, illness, stress, or mortality resulting from shipping delays. Any live arrival guarantee or claim shall be automatically void if shipment delivery is delayed for any reason outside the reasonable control of Pets and Go. ⸻ 6. HUSBANDRY REQUIREMENTS The Customer acknowledges that the health, wellbeing, and survival of any animal depends upon proper husbandry and environmental conditions. Pets and Go shall not be responsible for any injury, illness, decline in health, stress-related complications, or death resulting from: * Improper temperatures; * Improper humidity levels; * Inadequate enclosure conditions; * Improper nutrition or hydration; * Improper handling; * Housing with incompatible animals; * Failure to follow species-specific care requirements; * Failure to obtain veterinary care when needed; * Any husbandry error by the Customer or a third party. Pets and Go reserves the right to request photographs, videos, veterinary reports, enclosure specifications, temperature records, humidity records, and any other relevant information when investigating a claim. Any guarantee shall be immediately void if Pets and Go determines that proper husbandry requirements were not maintained. ⸻ 7. LEGAL OWNERSHIP AND REGULATORY COMPLIANCE The Customer bears sole responsibility for researching, understanding, and complying with all applicable federal, state, county, municipal, township, and local laws concerning the purchase, possession, transportation, breeding, sale, exhibition, and ownership of any animal. Pets and Go makes no representation, warranty, or guarantee regarding the legality of any animal within the Customer’s jurisdiction. The Customer acknowledges and agrees that it is their responsibility to determine whether ownership of an animal is lawful and whether any permits, licenses, registrations, inspections, or approvals are required prior to purchase. No refund, exchange, cancellation, credit, or reimbursement shall be issued because ownership of the animal is prohibited, restricted, regulated, or otherwise limited by any governmental authority. ⸻ 8. LIMITATION OF LIABILITY To the fullest extent permitted by law, Pets and Go shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising from or relating to: * The purchase of an animal; * The shipment of an animal; * The ownership of an animal; * Injury or illness of an animal; * Death of an animal; * Escape of an animal; * Breeding outcomes; * Property damage; * Personal injury; * Regulatory actions; * Permit denials. The Customer assumes all risks associated with the ownership, handling, transportation, breeding, and maintenance of live animals. In no event shall Pets and Go’s total liability exceed the original purchase price paid for the animal, excluding shipping charges, taxes, fees, veterinary expenses, attorney’s fees, or other consequential costs. ⸻ 9. GOVERNING LAW, VENUE, AND JURISDICTION This Agreement shall be governed by and construed in accordance with the laws of the state in which Pets and Go maintains its principal place of business, without regard to conflict-of-law principles. The Customer expressly agrees that any dispute, claim, controversy, lawsuit, or legal proceeding arising out of or relating to any purchase, shipment, transaction, or interaction with Pets and Go shall be brought exclusively in the state or county courts located within the county where Pets and Go maintains its principal place of business. The Customer irrevocably consents to the personal jurisdiction of such courts and waives any objection based upon venue, inconvenience, or forum non conveniens. ⸻ 10. ATTORNEY’S FEES AND COSTS In the event Pets and Go is required to enforce any provision of this Agreement, collect amounts owed, defend against claims, or otherwise participate in legal proceedings arising from a transaction with the Customer, Pets and Go shall be entitled to recover all reasonable attorney’s fees, court costs, expert witness fees, collection costs, and related legal expenses to the fullest extent permitted by law. ⸻ 11. SEVERABILITY If any provision of this Agreement is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. ⸻ 12. ACCEPTANCE OF TERMS By purchasing, reserving, financing, receiving, accepting delivery of, or otherwise acquiring any animal from Pets and Go, the Customer acknowledges that they have read, understood, and voluntarily agreed to all terms, conditions, limitations, disclaimers, and obligations contained within this Agreement. Pets and Go reserves the right to amend, modify, or update these policies at any time without prior notice
